These Terms of Use (“Terms”) apply to your access to and use of the beyondURdiagnosis website at [insert domain] and any related websites, pages, resources, products, programmes, events, email communications, course platforms or community spaces operated by 4DPublicSpeaking Pty Ltd (ABN 90161148465) (“we”, “us”, “our”, or “Company”).
This includes, without limitation:
* free beyondURdiagnosis articles, videos, newsletters and downloadable resources;
* the getURdiagnosis course and any founding, beta, live or hybrid cohort;
* the rebuildURbody private online community, if and when made available; and
* any related workshops, events, resources, tools or services (together, the “Services”).
By accessing the Site or using any Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
Additional terms may apply to a particular course, cohort, community membership, workshop, purchase or offer. If there is any inconsistency between these Terms and specific terms clearly stated for that Service at the time of purchase, the specific terms apply to the extent of the inconsistency.
1. Eligibility and personal use
You must be at least 18 years old and have legal capacity to enter into these Terms to purchase a paid Service, participate in a course or join a community.
The Site and Services are intended for your individual personal use only. You must not use them for commercial, professional, clinical, research, resale, redistribution, teaching, training or group-use purposes unless we have given written permission.
You are responsible for ensuring that your use of the Site and Services is lawful in your location.
2. Health education only
The Site and Services provide general educational and informational content about health information, evidence, healthcare conversations, self-advocacy and related subjects.
They are not medical advice and are not intended to diagnose, treat, cure or prevent any disease, condition or health concern.
We do not provide individual medical advice, diagnosis, prescriptions, treatment recommendations, therapy, counselling, clinical care, emergency support, or advice about whether you should begin, stop, change or avoid a medicine, supplement, test, procedure or treatment.
Your use of the Site or Services does not create a doctor-patient, clinician-patient, practitioner-client, therapeutic, counselling or other professional relationship with us.
You should make decisions about your health, medicines, tests, supplements, procedures and treatment options with appropriately qualified healthcare professionals who understand your individual circumstances. Do not delay seeking professional advice, urgent medical care or emergency assistance because of information provided through the Site or Services.
If you think you may be experiencing a medical emergency, seek urgent medical attention or contact emergency services immediately.
Research, medical guidance and clinical practice can change over time. We aim to use reliable sources and present information carefully, but we do not guarantee that information is complete, current, accurate, suitable or applicable to your circumstances.
Individual experiences, understanding and outcomes vary. We do not guarantee a particular health, diagnostic, treatment, personal, financial or other outcome from using the Site or Services.
3. Site content and intellectual property
Unless stated otherwise, the Site and all materials made available through the Services—including written content, videos, recordings, audio, graphics, worksheets, templates, tools, course materials, logos, branding, designs, text, research summaries and downloads (“Content”)—are owned by or licensed to 4DPublicSpeaking Pty Ltd and are protected by copyright, trade mark and other intellectual-property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Content for your own personal, non-commercial use.
Except where we expressly say otherwise in writing, you must not:
* copy, reproduce, republish, upload, post, display, distribute, transmit, sell, rent, licence or commercially exploit Content;
* share, transfer, resell or give another person access to a paid Service, account, recording, download or login*;
* record, screenshot, screen-capture, download, reproduce or redistribute live sessions, community discussions or other participants’ contributions;
* remove copyright, trade-mark, attribution or proprietary notices;
* adapt, translate, modify or create derivative works from Content;
* use Content to train an artificial-intelligence system, create datasets, develop competing materials, or provide services to others;
* use automated means, bots, scraping tools or data-extraction tools to access, copy or collect material from the Site or Services; or
* use our Content in connection with any public, commercial, professional, clinical, educational or promotional activity without our prior written permission.
Where we provide a resource expressly for download, you may download and print one copy for your personal use only. You must not share, resell, publish or distribute it.
4. Accounts, access and security
Some Services may require you to create an account or use login credentials. You must provide accurate and current information and keep your password and access details confidential.
You are responsible for all activity carried out through your account. Tell us promptly at [insert support email] if you become aware of unauthorised access to your account.
Access to paid Services is licensed to the purchaser only. You must not share login details, recordings, materials or member-only content with anyone else.
We may use third-party platforms to host videos, deliver courses, process payments, send emails, host communities or provide technical functionality. Your use of those platforms may also be subject to their terms and privacy policies.
5. Free resources and email communications
When you subscribe to receive a newsletter, download a free resource, register for an event or otherwise provide your contact details, we may send communications relating to the resource, event or Service you requested.
Where permitted by law and consistent with your preferences, we may also send marketing communications about our resources, courses, community, events or related offerings. You can unsubscribe from marketing emails at any time using the unsubscribe link in the email or by contacting us at [email protected].
Unsubscribing from marketing communications will not prevent us from sending necessary service communications, such as purchase confirmations, access instructions, changes to a booked event, important account notices or responses to your support request.
Our handling of personal information is explained in our Privacy Policy.
6. Purchases, payment and prices
Where you purchase a paid Service, you agree to pay the price and any applicable taxes, fees or charges displayed at checkout.
Prices are stated in Australian Dollars $AU unless otherwise stated. Your bank, card provider or payment processor may apply currency-conversion, international transaction or other fees outside our control.
We may use a third-party payment provider to process payments. We do not store your full payment-card details unless we expressly state otherwise.
We take reasonable care to ensure that prices and offer details are accurate. If there is an obvious pricing, technical or typographical error, we may correct the error and, where reasonably necessary, cancel the affected transaction and provide an appropriate refund.
We may change prices for future purchases at any time. A price change will not alter the price you have already paid for an existing Service, unless you separately agree to a change.
7. Founding Member Cohort for the getURdiagnosis Course and rebuildURbody Private Online Community
If you purchase the Founding Member Cohort Offer, the specific delivery terms stated at the time of purchase form part of your agreement with us.
The Founding Member Bundle of the getURdiagnosis Course and the rebuildURbody Private Online Community is a group education experience. It does not include individual health assessment, individual treatment planning, private clinical advice, case management, or unlimited one-to-one support.
We may make reasonable changes to session dates, presenters, content, resources, technology, delivery method or platform where reasonably necessary. If we make a material change, we will take reasonable steps to preserve the overall nature and value of the Service and notify affected participants where practicable.
You are responsible for ensuring you have the technology, internet connection and environment reasonably required to access the live sessions and recordings. We are not responsible for your own device, connectivity or software issues.
You must not record live sessions, copy recordings, share links, publish discussions, or disclose another participant’s personal information or health-related information.
8. Refunds, cancellation and Australian Consumer Law
Any voluntary cancellation, change-of-mind refund, satisfaction guarantee or other refund terms for a particular paid Service will be stated clearly in the applicable offer or checkout terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
If a Service does not comply with a consumer guarantee that applies under the Australian Consumer Law, you may be entitled to a remedy. Your rights will depend on the circumstances and the nature of the issue.
If we cancel a paid course or event before it begins and cannot provide a reasonable alternative, we will provide a refund of amounts paid for the cancelled Service.
If you cannot attend a live session, this does not automatically entitle you to a refund where the Service includes access to a recording or another reasonable form of access, subject always to any rights that cannot lawfully be excluded.
For refund or cancellation requests, contact [email protected] and include your name, email address, purchase date, Service purchased and reason for your request.
9. Community rules
If you access rebuildURbody or another community space operated by us, you agree to participate respectfully and safely.
You must not:
* post or send abusive, discriminatory, threatening, harassing, defamatory, sexually inappropriate, unlawful or otherwise harmful content;
* provide, request or present individual medical advice, diagnosis, treatment instructions, prescriptions or emergency advice;
* pressure, shame, exploit or intimidate another member;
* share another person’s name, contact details, image, story, screenshots, health information, messages or other personal information outside the community without their express permission;
* copy, record, download, screenshot, publish, repurpose or distribute community content;
* use community spaces to advertise, solicit, fundraise, recruit clients, promote affiliate links, send unsolicited private messages or sell products or services without our written permission;
* share your access, password or member-only materials;
* impersonate another person or misrepresent your identity, qualifications or experience; or
* use the community in a way that threatens the security, operation or wellbeing of the community or its members.
Views, comments, experiences and information shared by members are their own. They do not necessarily reflect our views and do not constitute advice from us. We do not endorse, verify or guarantee member contributions.
The community is not a medical, mental-health, counselling, crisis or emergency service. If you have immediate health or safety concerns, seek appropriate professional or emergency assistance.
We may moderate, remove content, restrict interaction, suspend access or terminate membership where reasonably necessary to protect members, enforce these Terms, comply with law or maintain the security and operation of the community. Where reasonably practicable, we will provide notice and an opportunity to remedy a breach, except where immediate action is reasonably necessary.
We cannot guarantee that every community member will follow these rules. Please report concerns to [email protected].
10. Your content, feedback and testimonials
You retain ownership of content you submit or share through the Site or Services, including comments, questions, feedback, photographs, stories, community posts and other materials (“User Content”).
By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process that User Content only to the extent reasonably necessary to operate, administer, moderate and provide the relevant Service.
You confirm that you have the right to provide the User Content and that it does not infringe another person’s intellectual-property, privacy or other legal rights.
We will not use your personal story, health information, photograph, video, testimonial, community contribution or other identifiable User Content in external marketing, promotion, advertising or public materials without your express permission.
If you voluntarily provide general suggestions or ideas to improve our Services, we may use those suggestions without compensation, provided we do not identify you personally without your consent.
11. Privacy and health-related information
We handle personal information in accordance with our Privacy Policy.
Depending on how you interact with us, you may choose to provide information that relates to your health or wellbeing. You are not required to provide detailed medical records, pathology or imaging reports, medication lists or other sensitive health information in order to access general Site content.
Please do not submit detailed health information through public comments, social-media channels, community posts or email unless we expressly request it through a secure and appropriate process.
Where we collect health-related or other sensitive information, we will do so only where reasonably necessary for the relevant activity, with appropriate consent where required, and as described in our Privacy Policy.
12. Third-party services, links and resources
The Site and Services may contain links to third-party websites, resources, research, products, services, software, payment processors, platforms or providers. These are provided for information or convenience only.
Unless we expressly state otherwise, a reference or link does not mean that we endorse, recommend, control or guarantee the third party or its information, availability, safety, suitability, performance or privacy practices.
We are not responsible for loss or damage caused solely by a third-party provider or platform outside our reasonable control. Where practicable, we will take reasonable steps to restore access or provide a reasonable alternative if a third-party technical issue affects a paid Service.
13. Availability and updates
We aim to keep the Site and Services available and functioning properly, but we do not guarantee uninterrupted, secure, error-free or virus-free access.
We may update, improve, modify, withdraw or discontinue parts of the Site, Content or Services from time to time. For an existing paid Service, we will not make a material change that substantially reduces its overall nature or value without reasonable notice or an appropriate remedy, subject to applicable law.
You are responsible for using reasonable security protections on your own device and maintaining appropriate internet access and software.
14. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential loss; loss of profit, revenue, opportunity, goodwill or data; or loss arising from your reliance on general educational information, third-party content, another member’s conduct, or circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy, warranty or liability that cannot lawfully be excluded, restricted or modified.
Where liability cannot lawfully be excluded but may lawfully be limited, our liability is limited to the extent permitted by law. This may include supplying the relevant Services again or paying the cost of having the relevant Services supplied again, where permitted.
15. Suspension and termination
We may suspend or terminate your access to the Site or Services where reasonably necessary because of:
* a serious or repeated breach of these Terms;
* non-payment, reversed payment, chargeback or suspected fraudulent activity;
* unauthorised access, account sharing or use of materials outside the personal licence granted by these Terms;
* abusive, threatening, harassing, unlawful or harmful conduct;
* infringement of another person’s rights;
* a security risk; or
* conduct that materially threatens the operation, reputation or safety of the Site, Services or community.
Where reasonably practicable, we will provide notice and an opportunity to remedy the issue before suspending or terminating paid access. We may act immediately where necessary to protect us, users, third parties or the security of the Services.
Suspension or termination does not affect rights or remedies that cannot lawfully be excluded.
16. Indemnity
To the maximum extent permitted by law, you agree to indemnify us and our directors, officers, employees, contractors and agents against reasonable losses, liabilities, claims, damages and costs arising directly from:
* your material breach of these Terms;
* your unlawful use of the Site or Services;
* User Content that infringes another person’s intellectual-property, privacy or other legal rights; or
* your fraudulent, wilful or seriously improper conduct.
This clause does not apply to the extent that a loss is caused by our own breach, negligence or unlawful conduct.
17. Events outside our reasonable control
We are not responsible for delay or temporary failure to perform an obligation where this is caused by an event outside our reasonable control, including natural disaster, fire, flood, severe weather, widespread telecommunications or utility failure, government action, civil disturbance, pandemic, serious illness or incapacity affecting essential personnel where no reasonable alternative is available, or a serious third-party platform outage.
We will take reasonable steps to minimise disruption and resume performance as soon as reasonably practicable. Nothing in this clause limits rights or remedies that cannot lawfully be excluded.
18. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia.
You and we submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. Nothing in these Terms is intended to exclude any mandatory rights that apply under the laws of your country of residence and cannot lawfully be excluded by agreement.
If you have a concern or dispute, contact us first at [insert support email]. We will aim to consider and respond to your concern in good faith. Nothing in this clause prevents either party from exercising a legal right or remedy available to them.
19. Changes to these Terms
We may update these Terms from time to time to reflect changes in our Services, business practices or legal obligations. The current version will be published on this page with the updated “Last updated” date.
Changes will not retrospectively remove rights you have already acquired under an existing purchase unless required by law. If a material change affects an existing paid Service, we will take reasonable steps to notify affected participants.
